Bradley H. Layne recently received advanced level training, from the American Association of Premier DUI Attorneys, on how to use information from medical staff to win DUI cases. Bradley received training on how law enforcement and emergency medical personnel have different priorities when they encounter a suspected impaired driver. These differences lead to contradictions between what law enforcement and medical staff document and may give the defense more ammunition to show that law enforcement was inaccurate, incomplete, or even dishonest. The American Association of Premier DUI Attorneys has compiled information from Judges, Traffic Safety Resource Prosecutors (the Top DUI Prosecutors in each State), DUI Prosecutors, current Law Enforcement Officers, former Law Enforcement Officers, and DUI Defense Attorneys to determine exactly what skills, knowledge, training, tools, resources, and strategies win the most DUI cases at trial and are also used to get DUI cases successfully resolved for the defense prior to trial.

Bradley H. Layne focuses his practice in the areas of maritime injuries, product liability, personal injury, wrongful death, Social Security disability and criminal defense, including DUI. Brad is a 1987 Magna Cum Laude graduate of Marshall University with a Bachelor of Business Administration degree in Accounting. He earned his Juris Doctor degree from the West Virginia University College of Law in 1991.

In law school, he served as Articles Editor of the West Virginia Review and was also honored with selection to The Order of the Coif, the most prestigious award obtainable by a law student, given only to those students who graduate in the top of their law school class. He entered the practice of law in 1991, joining the firm of Robinson and McElwee in Charleston, West Virginia. In 1992 joined the firm of C. Dallas Kayser L.C., the predecessor of Kayser Layne Clark PLLC. Brad has over 24 years of experience in representing injured and disabled individuals in civil cases against insurance companies and large corporations as well as individuals charged with a crime by government.

 

He was the author of Post-Erisa Interpretation of Pre-Erisa Pension Plans: Dissention among the Circuits, published in Volume 92, Number 3 of The West Virginia Law Review. The article was also selected by Westlaw from several articles to be published on their service at the time of writing. He was also the co-author of Psychiatric Disability: Legal and Administrative Dimensions, National Business Institute Seminar, (November 1991).

He is a member of the West Virginia Association of Justice , the American Association of Justice—Admiralty Law and Social Security Disability Sections, Mason County Bar Association (former president), and West Virginia State Bar He is licensed to practice in both State and Federal court in West Virginia and has practiced with special permission in various other state and federal courts.

In addition to his professional memberships, he is one the original founding members of Bend Area CARE, a local charitable organization that provides aid to individuals and families struck by hardship in the local area and also provides Christmas presents to underprivileged children. He is also a member of several other civic and fraternal organizations and is an active musician.

Brad resides on the family horse farm outside New Haven, West Virginia, with his wife Amy, 2 daughters, Alexa and Alivia, and several purebred Arabian horses. Along with spending time with his family, he enjoys playing, writing, and recording music, horseback riding, and snow skiing and boating.
