Cody Salfen recently received advanced level training, from the American Association of Premier DUI Attorneys, on how to use information from medical staff to win DUI cases. Cody received training on how law enforcement and emergency medical personnel have different priorities when they encounter a suspected impaired driver. These differences lead to contradictions between what law enforcement and medical staff document and may give the defense more ammunition to show that law enforcement was inaccurate, incomplete, or even dishonest. Among the wide array of criminal cases he handles, Cody’s past results have included securing complete dismissals of criminal charges for many of his clients, court ordered findings of factual innocence/exonerations in some cases, and a variety of other favorable negotiated case resolutions.

Cody recently prevailed in a DMV administrative proceeding for one of his DUI clients, thereby avoiding an automatic suspension of the client’s drivers license when the client was accused of a second DUI. The case stemmed from an allegation that the client drove with a blood alcohol concentration (“BAC”) of over 0.25% (over three times the legal limit) and was allegedly involved in a non-injury traffic collision. Cody achieved a win for his client at the DMV hearing by methodically analyzing the facts the case and the FST/Field Sobriety Test procedures that were administered by law enforcement. During this careful analysis, Cody discovered a subtle, yet major flaw in the arresting officer’s DUI investigation. Thereafter, utilizing the rules of evidence specific to California DMV hearings, Cody was able to successfully bring these factual issues and procedural flaws by law enforcement during the DUI investigation to light during the DMV Administrative Per Se hearing – ultimately resulting in the DMV hearing officer ruling in favor of Cody’s client and not suspending the client’s drivers license. After the DMV hearing, the victory in the DMV proceeding allowed Cody to leverage a much more favorable result during the separate criminal portion of the case – a case where the client was facing extremely stiff penalties and significant jail time due to a prior DUI conviction.

Another recent case involved one of Cody’s DUI clients who was initially arrested for a very serious DUI charge – felony DUI (DUI causing injury to another), an offense that carried a possible maximum sentence of up to three years in State Prison. The arrest resulted from the client allegedly driving with a blood alcohol concentration/”BAC” of nearly twice the legal limit, allegedly crashing into a parked car at a relatively high rate of speed, and one of the client’s passengers allegedly sustaining injury as a result of the collision. Cody successfully negotiated with the District Attorney’s Office and the District Attorney thereafter amended the charge to misdemeanor DUI (with no allegation of injury). The client was able to avoid a felony conviction, avoid the much more serious “DUI with Injury” conviction, avoid any actual jail or prison time, and avoid all of the personal, professional, and legal consequences a felony conviction and a “DUI with Injury” conviction would have entailed.

As a DUI lawyer, Cody understands and embraces the basic premise of our justice system that is all too often trampled upon, overlooked, and/or wholly ignored by prosecutors, jurors, judges, defense attorneys, and the like – that is, the presumption of innocence. All individuals accused of violating the law are innocent if and until proven guilty in a court of law. Just because someone is arrested for DUI or even charged with DUI, this does not necessarily mean they are guilty (and certainly doesn’t automatically mean that the government can actually prove beyond a reasonable doubt that the individual is guilty of DUI).
