Officers will testify that they conducted the Walk and Turn and the One Leg Stand Tests properly. However, in almost every case, officers conduct the tests improperly by doing one or more of the following: giving wrong instructions, giving improper demonstrations, failing the test themselves during their own demonstration of the test, and improperly assessing a person’s performance on the tests. Nicholas received training on exactly what to look for during the Walk and Turn and the One Leg Stand Tests and how to invalidate the tests by using the officer’s own National Highway Traffic Safety Administration (NHTSA) Manuals against them in the courtroom.
