Daniel Hartpence recently received advanced level training, from the American Association of Premier DUI Attorneys, on winning DUI – Drug cases. It is critically important to understand that officers are trained that there are many medical conditions, emotions, and feelings that will cause a sober driver to exhibit signs and symptoms similar to drug impairment. It is also important to understand that toxicology results cannot be used to prove that a person was impaired and blood and urine tests will disclose the presence of drugs long after the effects have worn off. The best attorneys are able to work backwards and reverse engineer the case after having the toxicology results and the Drug Recognition Expert (DRE) Evaluation. It is key to cross-examine the arresting officer and get them to admit as many times as possible the inconsistent findings in the case that the defense discovers by attacking the possible effects, duration of effects, and the expected results of the DRE Evaluation. This training was provided by Dave Cox, the Founder and President of the American Association of Premier DUI Attorneys.

Danny Hartpence was born and raised in Fayetteville, Georgia. As the son of a chiropractor and teacher, he was instilled with the drive and motivation necessary to succeed and excel. He went to Starr’s Mill High School, then on to Eckerd College in St. Petersburg, Florida. At Eckerd, Danny played baseball and earned a Bachelor of Science degree in Biochemistry and a minor in Classic History.
While attending college at Eckerd, Danny fell in love with the Tampa Bay Area and decided to attend Law School at Stetson University College of Law. While there, he was a member of several organizations, including the Board of Governors for the Young Lawyers Division – Student Division, and was awarded multiple scholarships and honors for his work at Stetson. After his first year of law school, Danny attended the Intellectual Property Summer Institute at Franklin Pierce Law School (now University of New Hampshire), where he underwent intensive Intellectual Property studies. After his second year of law school, Danny was selected as a law clerk for Brannock & Humphries in Tampa. At Brannock & Humphries, he learned how complex and important appellate work is, and how to effectively write briefs and research appellate issues. During his final year at Stetson, he served as a Certified Legal Intern with the State Attorney’s Office for the 13th Judicial Circuit, in Hillsborough County.
After graduation Danny accepted a position with the Hillsborough County State Attorney’s Office. As an Assistant State Attorney, Danny tried over 100 cases ranging from 1st degree felonies, punishable by life, to 2nd degree misdemeanors. He served in county, traffic, juvenile, and felony courts. Danny has written multiple appeals and successfully argued numerous motions. The experience Danny gained at the State Attorney’s Office allows him to understand the prosecution’s intentions and has molded him into a skilled trial attorney.
After his time at the State Attorney’s Office, Danny accepted a position at Pearlman & Clark, P.A., where he is now fully committed to the firm’s belief in serving their clients to the best their ability. It is Danny’s, and the firm’s, belief that clients be kept informed every step of the way throughout the stressful situation of a criminal or civil case.
