It is critically important to understand that officers are trained that there are many medical conditions, emotions, and feelings that will cause a sober driver to exhibit signs and symptoms similar to drug impairment. It is also important to understand that toxicology results cannot be used to prove that a person was impaired and blood and urine tests will disclose the presence of drugs long after the effects have worn off. The best attorneys are able to work backwards and reverse engineer the case after having the toxicology results and the Drug Recognition Expert (DRE) Evaluation. It is key to cross-examine the arresting officer and get them to admit as many times as possible the inconsistent findings in the case that the defense discovers by attacking the possible effects, duration of effects, and the expected results of the DRE Evaluation.
